1. Introduction
These Terms and Conditions form the agreement between drivers ("you") and LISO Ventures Limited, operating under the brand TrustyRides ("we", "us", "our"). By registering and providing services as a driver on our platform, you agree to comply with these terms, which establish a binding legal agreement.
2. Role of Drivers
As a driver, you are engaged to provide transportation services to clients using the TrustyRides platform. You operate as an independent contractor, not as an employee of LISO Ventures Limited.
3. Driver Independence
You are an independent contractor, fully responsible for managing your operations. You are not an employee of TrustyRides or LISO Ventures Limited and must independently handle your business obligations.
4. Responsibilities of Drivers
a. Licensing, Compliance, and Taxation:
- Obtain and maintain all necessary licenses, permits, and approvals required to operate your vehicle legally and provide transportation services in your jurisdiction.
- Comply with all relevant transportation, safety, and employment regulations and standards.
- Register with the Kenya Revenue Authority (KRA) and ensure compliance with all tax obligations, including filing and payment of taxes related to earnings from TrustyRides.
b. Vehicle Maintenance and Safety:
- Maintain your vehicle in a safe, clean, and roadworthy condition to meet the operational standards required by TrustyRides.
- Ensure that your vehicle is covered by valid insurance that meets or exceeds the minimum legal requirements for commercial transportation services.
c. Professional Conduct:
- Conduct all services professionally and respectfully towards clients.
- Adhere to the customer service standards and quality levels prescribed by TrustyRides.
5. Financial Terms
a. Earnings and Payments:
- You will earn payments based on the fare structure specified by TrustyRides, which will be detailed in your individual driver agreement.
- All payments will be processed through the TrustyRides platform and are subject to the terms and conditions herein.
b. Withdrawals and Payouts:
- You can withdraw your earnings through our integrated payment service, Pesapal.com, which supports payouts to various payment methods including Safaricom MPESA, Airtel Money, Visa, and Mastercard.
- Detailed instructions and terms for withdrawals will be provided within the TrustyRides driver portal.
c. Expenses:
- You are responsible for all operational expenses associated with your vehicle, including but not limited to fuel, maintenance, repairs, and insurance.
6. Use of Platform
a. Platform Access and Security:
- Maintain the confidentiality and security of your account information.
- Do not share your account credentials with any third parties.
b. Data Handling and Privacy:
- Adhere to applicable data protection laws regarding the handling and protection of personal information of clients.
7. Termination
a. Termination by TrustyRides:
- TrustyRides reserves the right to terminate this agreement with immediate effect if there are credible indications that you are involved in malicious activities or collusion with other entities that could harm clients or the TrustyRides platform. This includes but is not limited to fraud, theft, providing misleading information to TrustyRides or its clients, or engaging in any illegal activities.
b. Termination by Driver:
- You may terminate this agreement with appropriate notice, as specified in your individual driver agreement.
c. Effects of Termination:
- Upon termination, you must cease all use of the TrustyRides platform and any provided materials or information. All pending financial obligations owed to you by TrustyRides will be processed according to the terms outlined in Section 5.
8. Disclaimer of Warranties and Limitation of Liability
We provide the TrustyRides platform on an "as is" and "as available" basis. We disclaim all warranties, express or implied, regarding the availability, reliability, or your access to our services.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of Kenya.
