These Terms and Conditions govern the partnership between you, the service provider ("Partner"), and LISO Ventures Limited, operating under the brand TrustyRides ("we", "us", "our"). By using our technology platform, you agree to these terms, which form a binding legal agreement.
2. Service Description
TrustyRides provides a technology platform that connects Partners with clients seeking a variety of services, including but not limited to transportation, restaurant services, grocery shopping, home repairs, cleaning services, and much more. Our platform facilitates these connections and provides tools to enhance your business operations, but does not control or directly manage the specific services provided by Partners.
3. Independence of Partners
As a Partner, you operate as an independent entity and are not considered an employee or agent of LISO Ventures Limited. You are solely responsible for all decisions related to your service offerings and compliance with applicable laws.
4. Responsibilities of Partners
a. Licensing, Compliance, and Taxation:
- Obtain and maintain any necessary licenses, permits, and approvals required to legally offer and perform your services within your jurisdiction.
- Ensure compliance with all local and national regulations applicable to your service offerings.
- Register with the Kenya Revenue Authority (KRA) and comply with all tax obligations, including filing and payment of taxes related to earnings from TrustyRides.
b. Standards and Quality of Service:
- Maintain high standards of quality and safety in all services offered to clients.
- Ensure that any goods provided (e.g., food, home supplies) meet local health and safety standards.
- Ensure that services such as home repairs, cleaning, and other personal services are performed professionally and to the satisfaction of clients.
c. Legality of Services:
- You must not offer or promote any service or product that is illegal under any applicable laws. Engaging in illegal activities will lead to immediate termination of this agreement.
5. Financial Terms
a. Earnings and Payments:
- You will be compensated according to the fare structure agreed upon with TrustyRides, detailed in your specific agreement.
b. Payouts:
- Earnings from the platform can be withdrawn using Pesapal.com, which allows payouts to various payment methods including Safaricom MPESA, Airtel Money, Visa, and Mastercard.
- Ensure that your Pesapal account and all other payment methods are set up and maintained according to the guidelines provided by TrustyRides.
c. Expenses:
- You are responsible for all operational costs associated with your services, including but not limited to procurement of materials, maintenance of tools and equipment, and any other service-related expenses.
6. Use of Platform
a. Data Handling and Privacy:
- Adhere to applicable data protection laws. Our Privacy Policy, outlines how we collect, use, and protect personal information and your responsibilities in handling such data.
b. Platform Access and Security:
- Ensure the security and confidentiality of your account and the information accessed through our platform.
7. Termination
a. Immediate Termination by TrustyRides:
- TrustyRides reserves the right to terminate this agreement with immediate effect if there are credible indications that you are engaged in illegal or fraudulent activities, including but not limited to selling or promoting illegal services or products.
b. Termination by Partner:
- You may terminate this agreement with appropriate notice, as specified in your specific agreement.
c. Effects of Termination:
- Upon termination, you must cease all use of the TrustyRides platform and any provided materials or information. All pending financial obligations owed to you by TrustyRides will be processed according to the terms outlined in Section 5.
8. Disclaimer of Warranties and Limitation of Liability
TrustyRides provides the platform "as is" and does not guarantee continuous or uninterrupted access. We are not liable for indirect or consequential damages arising from your use of the platform.
9. Amendments
We may amend these terms at any time by posting revised terms on the TrustyRides website. Your continued use of the platform constitutes acceptance of the new terms.
10. Governing Law
These terms are governed by the laws of Kenya.
